spouse visa

• I married my husband in pakistan in 2002 and he got a visa straight away and came to uk with me, but after a few months he committed an offence and served a 18 months prision sentance. When he was released i sent off for his application in 2003 but to date have not heard anything back from homeoffice. Now the homeoffice is saying that his passport has expired and he needs to go back to pakistan and get entry clearance but i dont think i want to stay with him anymore as i feel he only with me for visa and is abusive also. once i go back with him to pakistan can i tell the british high commision there that i dont want him her or delay his application? please help
